Terms of Use

1. Purpose of the service

PrestoCast is a platform that allows users to send voice notes via Telegram, WhatsApp or the web, which are converted into podcast episodes accessible through a public RSS feed. The service is free of charge.

2. Registration and account

Using the service requires creating an account. Registration can be done through the web (email and password) or by starting a conversation with our bot on Telegram or WhatsApp. Each user receives a unique username and their own RSS feed.

The user is responsible for maintaining the confidentiality of their login credentials.

3. Published content

The user is solely responsible for the audio content they publish through PrestoCast. By publishing content, the user declares that they hold the necessary rights over it and that it does not infringe on the rights of third parties.

The user retains all intellectual property rights over their audio content. PrestoCast only obtains a license to host, distribute and play the content within the scope of the service (RSS publication, web playback, distribution to podcast players).

4. Prohibited uses

It is prohibited to use PrestoCast to:

• Publish illegal, defamatory, threatening content or content that incites hatred.
• Publish content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability or gender identity.
• Harass, intimidate or bully other people.
• Publish content that promotes violence or terrorism.
• Publish child sexual abuse or exploitation material (CSAM).
• Spread medical misinformation that could endanger people's health.
• Infringe on the intellectual property rights of third parties.
• Distribute spam or unauthorised advertising content.
• Impersonate another person.
• Interfere with the operation of the service.

5. Availability and warranties

PrestoCast is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability of the service or indefinite preservation of content. We reserve the right to modify, suspend or discontinue the service at any time.

6. Limitation of liability

PrestoCast shall not be liable for direct, indirect, incidental or consequential damages arising from the use of the service, including data loss or service interruption.

7. Termination

The user can delete their episodes at any time through the bot or the web. To delete the account entirely, contact us at legal@prestocast.com.

We reserve the right to suspend or delete accounts that breach these terms.

8. Changes

We reserve the right to modify these terms at any time. Changes will be effective from the date of publication on this page. Continued use of the service after changes implies acceptance.

9. Governing law

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Mataró (Barcelona), Spain.

2. Data we collect

• Account information: username, email address, profile photo.
• Platform identifiers: Telegram user ID or WhatsApp phone number, used to link your messaging account to your PrestoCast profile.
• Audio content: voice messages you send to create podcast episodes.
• Images: podcast cover art and episode cover art you upload.
• Usage data: episode publication dates, episode numbers.

3. Purposes of processing

• To create and manage your user account.
• To publish and distribute your podcast through a public RSS feed.
• To send service-related communications (e.g., password reset codes).
• To generate anonymous episode download statistics.

4. Legal basis

• Performance of a contract (Art. 6.1.b GDPR): processing is necessary to provide the requested service.
• Consent (Art. 6.1.a GDPR): when the user registers and voluntarily publishes content.
• Legitimate interest (Art. 6.1.f GDPR): for the maintenance and improvement of the service.

6. International transfers

7. Your rights

Under the GDPR, you can exercise the following rights:

• Access: know what data we hold about you.
• Rectification: correct inaccurate data.
• Erasure: request deletion of your data.
• Portability: receive your data in a standard format.
• Objection: object to certain processing activities.
• Restriction: request restriction of processing.

8. Data retention

We retain your data for as long as your account is active. If you delete your account, we will delete your personal data within a reasonable period, unless we are required to retain it by law.

Episodes published via the RSS feed may have been downloaded by third parties (podcast players) prior to deletion, which is beyond our control.
